Terms of Service

These Terms of Service ("Terms") govern your use of the Anvil Weather desktop application, website and related services (together, the "Service"), operated by Anvil Weather ("we", "us"). By creating an account, installing the application or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Not a safety-of-life service

Anvil Weather is not a warning service and must never be your sole source of severe weather information. The Service displays weather data for informational and situational-awareness purposes only. It is not designed, tested or certified for the protection of life or property. You must always heed official warnings, watches and instructions issued by the U.S. National Weather Service (NWS), your local authorities and emergency management. In any situation involving a threat to life or property, rely on official sources — including NOAA Weather Radio, Wireless Emergency Alerts and local media — not on the Service.

2. Data accuracy and availability

The Service ingests data from third-party sources, including NOAA/NWS (NEXRAD radar, warnings, SPC products), GOES satellites, model output (HRRR) and community networks. We do not control these sources and make no guarantee that any data shown is accurate, complete, timely or available. Radar and warning data may be delayed, degraded, incomplete or missing entirely, without notice. Derived products — including but not limited to in-house storm cells, tornado detections ("RDTC"), preliminary EF estimates, contours and 3D renderings — are experimental algorithmic estimates, not official detections or forecasts, and may produce both false positives and misses.

3. Accounts

You must create an account to use the Service, providing a valid email address. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 13 years old (or the minimum age required in your jurisdiction). We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, billing and refunds

The free tier provides a limited feature set. Anvil Weather Pro is a paid subscription (monthly or annual) sold and processed by Freemius, Inc., our merchant of record. Freemius handles payment, taxes, invoices and refunds under its own terms. Subscriptions renew automatically until cancelled. You can cancel at any time from your account page; Pro remains active until the end of the period you have paid for, after which your account reverts to the free tier. Refund requests are handled per the refund policy shown at checkout. Prices may change with notice; changes apply from your next renewal. A subscription covers your personal devices for individual use, not simultaneous use by multiple people.

5. Acceptable use

You agree not to: (a) resell, rebroadcast, scrape or bulk-redistribute data or output from the Service; (b) reverse engineer, decompile or circumvent technical or licensing protections; (c) use the Service to build a competing data feed; (d) use the Service in any unlawful manner or in a way that burdens or disrupts our infrastructure or upstream data providers; (e) share account credentials to bypass subscription limits.

6. Chaser and community data

The Service can display positions and public live streams of storm chasers and spotters from community networks. This information is provided for situational awareness only. We are not responsible for the conduct, content or accuracy of third-party chasers or their streams. Do not use the Service to navigate toward dangerous weather. Storm chasing is inherently dangerous and is undertaken entirely at your own risk; nothing in the Service constitutes encouragement, instruction or guidance to pursue severe weather in person.

7. Driving

Never operate the Service while driving. Routing and navigation features are provided for convenience, may be inaccurate, and must only be used in compliance with traffic laws, with a passenger operating the app, or while safely stopped.

8. Intellectual property

The Service, including its software, design and branding, is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the application for personal, non-commercial use in accordance with these Terms. Government weather data displayed by the Service is in the public domain; attribution for third-party sources appears in the app. Anvil Weather is not affiliated with or endorsed by NOAA or the NWS.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY DATA IT DISPLAYS IS CORRECT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING RELIANCE ON ANY DATA, DETECTION OR FORECAST IT DISPLAYS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (OR US $10 IF YOU PAID NOTHING). Some jurisdictions do not allow certain exclusions; in those jurisdictions the exclusions apply to the fullest extent permitted.

11. Indemnity

You will indemnify and hold us harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.

12. Dispute resolution

These Terms are governed by the laws of the United States and the state of our principal place of business, without regard to conflict of laws rules. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration; you and we each waive any right to a jury trial or to participate in a class action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms. Nothing in this section prevents either party from seeking relief in small-claims court.

13. Changes and termination

We may modify the Service or these Terms; material changes will be posted here with an updated effective date, and continued use after a change constitutes acceptance. We may suspend or terminate the Service or your access to it for violation of these Terms. You may stop using the Service and delete your account at any time.
